Terms and Conditions

Welcome to Clean Warks! These terms and conditions constitute the full and complete Service Agreement (the “Agreement”) between you (the “Customer” or “Client”) and Clean Warks (the “Company”, “We”, “Us”) for the provision of residential and commercial cleaning services in Kerala, India. By using our services, you agree to comply with all the terms of this Agreement.

1. Cleaning Services

1.1 Clean Warks provides residential and commercial cleaning services (the “Service”) at locations specified by the Customer (the “Premises”).

1.2 The Service will include cleaning duties agreed upon at the time of booking. Clean Warks will provide one or more cleaners (the “Cleaner”) to attend the Premises at a mutually agreed time and date (the “Service Time”).

1.3 Clean Warks endeavors to provide the Service faithfully, diligently, and in a timely and professional manner.

2. Additions and Amendments

2.1 Any changes to the Service must be agreed upon by Clean Warks prior to the Service Time.

2.2 If the Customer requires additional services or variations at the time the Service is being performed, the Customer must first contact Clean Warks by telephone or email. The Cleaner is not authorized to agree to changes directly.

3. Bookings

3.1 Customers may make a booking either in person, by telephone, through the booking link or by email.

3.2 At the time of booking, the Customer must provide details of any hazards, slippery surfaces, risks, or dangers at the Premises.

3.3 Clean Warks reserves the right not to accept a booking for any reason.

4. Payment Terms

4.1 The Customer agrees to pay an advance amount of INR 1000 at the time of booking. The remaining balance is to be paid in full upon completion of the Service, before the Cleaner leaves the Premises.

4.2 Payment methods include cash, check, bank transfer, or credit card. A 2% surcharge applies to credit card payments.

4.3 If balance payment is not made after the Service Time, Clean Warks reserves the right to charge a late payment fee of INR 500.

5. Cancellation and Rescheduling

5.1 The Customer must provide Clean Warks with at least 48 hours’ notice to cancel or reschedule the Service.

5.2 If the Customer cancels or reschedules the Service with less than 48 hours’ notice, 50% of the booking fee will not be refunded.

5.3 If the Customer cancels or reschedules the Service within 24 hours of the scheduled Service Time, the entire booking fee of INR 1000 will not be refunded.

5.4 If Clean Warks is unable to access the Premises at the scheduled Service Time due to the Customer’s failure to provide access, a lockout fee of INR 500 will be charged.

6. Customer Responsibilities

6.1 The Customer will provide a safe working environment for the Cleaner to perform the Service.

6.2 The Customer will provide the Cleaner access to all necessary utilities, including hot and cold water, electricity, and rubbish bins.

6.3 The Customer will inform Clean Warks of any hazards, slippery surfaces, risks, or dangers at the Premises before the Service Time.

6.4 The Customer must ensure that children and pets are supervised or secured during the Service.

7. No Engagement of Cleaners

7.1 The Customer agrees not to solicit, engage, employ, or contract with any Cleaner provided by Clean Warks for any period during which services are provided by Clean Warks and for a period of 12 months following the termination of services.

7.2 If the Customer breaches this clause, they agree to pay Clean Warks a referral fee of INR 25,000 per Cleaner.

8. Complaints and Claims

8.1 Any complaints or claims must be reported to Clean Warks within 24 hours of the Service.

8.2 Clean Warks will endeavor to resolve any issues quickly and efficiently. At its discretion, Clean Warks may offer the Customer a re-clean.

9. Liability

9.1 Clean Warks is not responsible for not completing the Service due to the Customer’s inability to provide a safe working environment.

9.2 Clean Warks is not liable for any damage caused by defective cleaning materials or equipment provided by the Customer.

9.3 Clean Warks is not responsible for any existing dirt, wear, damage, or stains that cannot be completely cleaned or removed.

10. Insurance

10.1 Clean Warks holds commercial general liability insurance.

10.2 Any damages must be reported within 24 hours of the Service to be eligible for claims.

10.3 Clean Warks is not liable for any loss or damage due to events beyond its control (force majeure).

11. Privacy Policy

11.1 The Customer’s information will be used solely for the provision of the Service and will not be shared with third parties unless required by law.

11.2 Clean Warks will take all reasonable precautions to protect the Customer’s personal information.

12. Changes to this Agreement

12.1 Clean Warks reserves the right to update or modify these terms and conditions at any time without prior notice. Changes will take effect upon publication on the Clean Warks website.

13. Severability

13.1 If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Governing Law

14.1 This Agreement is governed by the laws of Kerala, India. Any disputes will be subject to the exclusive jurisdiction of the courts of Kerala.
